Government legislation is set to take effect in April that will see fees for personal injury solicitors come out of the compensation awarded to the successful party.
Initially passed in May last year, the Legal Aid, Sentencing and Punishment of Offenders Act 2012 will see lawyers able to claim up to 25% of the compensation awarded to their clients in the event of a successful case, rather than being allowed to claim all their fees from the opposing side as is the case now.
What this means is that if you win a case, your opponent will not have to pay all your costs any more on top of the compensation you have been awarded. Your solicitor fees will be your responsibility, and a contribution may come out of the amount you have been awarded.
To help balance this out, the government has also stated that all compensation should go up by 10% in personal injury cases in order to ensure those who make a successful claim are not too disadvantaged.
