What is liability?
Liability is defined as “the state of being legally responsible for something”. This means that the person who accepts liability for your road accident is accepting the accident, and the injuries the other party suffers, were their fault.
In many cases, liability will be obvious. Drivers and insurers, eager to move on from an accident will accept liability with a minimum of fuss. Some accidents, however, are more complex, with a liability dispute arising as part of proceedings.
What is a liability dispute?
A liability dispute arises when the party you believe to be at fault for the accident denies responsibility, or insists you are partially responsible. Should this occur, you will then be required to provide evidence of the other party being at fault if you are to secure the maximum compensation and protect your no-claims discount.
Should you be found to have joint fault with the other party, the amount you’re able to be awarded will reduce in-line with your level of fault.
For example, if fault is found to be 50/50, a potential maximum award of £1,000 will be reduced to £500. If you are found to be 75% at fault, this drops again to £250, making correctly apportioning liability a vital part of any claim.
In order to obtain the right amount of compensation, it’s vital to establish liability correctly. If you feel this has not been done, and you are concerned the compensation you may receive is not going to be adequate for your pain or to cover your expenses, our solicitors can help.
How to prove liability following an accident?
A number of critical pieces of evidence can help prove who is at fault following an accident, making it vital to take the following steps if possible:
- Take photographs of the scene of the accident, including the damage incurred on both cars and the overall state of the road
- Note down the names and contact details of any witnesses, asking if they’d be happy to make a statement on what they saw
- The registration number of any other cars involved in the accident alongside the names and contact details of their drivers
- Ensure you have the name, officer number and station of any Police Officers who took statements
- A detailed plan of the area where the accident took place
Although it may not be possible to collect all this evidence, injuries may preclude you taking photographs or getting witness information, for example, all the information you are able to gather will help you build a complete picture of the events leading up to the accident and who may have been at fault.
Do I have to use the solicitor my insurance firm recommends?
Many insurers have a list of preferred solicitors with whom they partner and, upon being notified of an accident, will point you to one of these firms. You are not, however, required to use any firm recommended by your insurer.
It is important the solicitor you choose to represent you is someone you feel comfortable speaking to and is easy to contact if you wish to achieve the best result possible. Taking the time to find your own solicitor will help you do this.
When serious injuries are involved, it’s important to instruct a firm that specialises in claiming compensation in road traffic accidents, to ensure the best outcome for your case.
