Whilst not represented in any figures given by compensation calculators, due to the fact that they are unique in each type of Car Accident Compensation Claims, ‘Special Damages’ are also likely to make up part of your overall compensation settlement amount.
Special Damages will go on to include any financial losses suffered, as well as any additional expenses that you may have incurred because of your injury following a road traffic accident, such as travel costs and medical expenses.
Other contributory factors must also be considered when establishing the value of the Special Damages, for example, long-lasting debilitating physical health problems that could stop you from working or any long-term medical costs.

Generally, in the UK, you are required to initiate a personal injury claim within 3 years from the date of the accident under section 11 of the Limitation Act 1980 (LA 1980). There are, however, a number of exceptions to this general rule.
In addition to the special circumstances listed below, you may, in exceedingly rare circumstances, be exempted from the limitation period under Section 33 of the Limitation Act 1980.
If a child is injured in a car accident and they are aged under 18, then a parent, guardian or other suitable “litigation friend” is entitled to make Car Accident Compensation Claims on their behalf at any time up to the date of the child’s 18th birthday, irrespective of have long prior to that date the accident happened.
If a claim is not made on behalf of the child, then once they reach the age of 18, they have three years from the date of their 18th birthday to make a compensation claim for themselves.
In instances where a car accident results in a fatality, close family members may be able to make an injury claim on behalf of their deceased relative, providing that the statutory 3 year limitation period did not expire during the lifetime of the deceased person. In such cases, the family has a further 3 years from the date of the death of their relative in which to make a compensation claim.
If the person injured was receiving treatment under the Mental Health Act 1983 at the time of their injury, the three-year deadline in which they would be able to make a compensation claim would not start until the date on which they were discharged as a patient, or the date the conditions of their disability ended. The 3-year limit starts from the earlier of the two dates.
In some cases, it may also be possible for a family member or other suitable litigation friend to make a claim on behalf of a claimant currently receiving treatment. In some instances, Car Accident Compensation Claims of this nature may be brought before the claimant has been discharged.
