Dealing with injury claims this winter

With Christmas around the corner, it’s a time for everyone to be celebrating and enjoying the festive season.

Of course, winter does bring its own hazards, particular with the cold weather setting in and making conditions potentially treacherous for both pedestrians and drivers alike.

Here, Sheldon Davidson Solicitors offers some tips for how to steer clear of any unfortunate accidents during the winter months.

Slipping on ice or snow

This is something that everyone needs to be aware of. Ice and snow can make pavements and other walkways particularly treacherous, and there are probably many of us who have had a near miss losing our footing on an icy surface.

Of course, there are certain areas where you have the right to expect a safe path, for example, if the area of land is owned by a private business such as a restaurant or supermarket. It may also be that the local council should have made an effort to clear the area.

If those responsible for a walkway have failed to clear it, or done so negligently (for example, melting snow with hot water is likely to create dangerous ice patches), you may be entitled to compensation if you slip or fall and suffer an injury.

Icy roads

Just as icy pavements are dangerous for those on foot, frozen roads are equally dangerous for vehicles. There is an increased risk of road traffic accidents during winter, for the simple reason that driving conditions are more challenging.

Of course, you can only control your own vehicle, and unfortunately, there will always be some drivers who do not take care on the road, and who fail to adjust their driving to allow for the icy conditions. This can sometimes cause an accident, and if you are an innocent victim in this situation, you may be entitled to claim compensation.

This will normally be claimed through the ‘at fault’ driver’s insurer, but there are provisions in place to help you if the other vehicle leaves the scene or the driver is uninsured. In these circumstances, the Motor Insurers’ Bureau (MIB) will help with your claim.
