SDS acted for a self-employed carpenter who was working on the construction of the new Manchester Civil Justice Centre.

The client was injured when his hand was cut when using his own circular saw.

The case was difficult in that the client was self-employed and responsible for his own system of work.

However, on the basis that all workers on site had to wear fabric gloves (which was pointless when using a circular saw as such gloves did not provide protection and were cumbersome), the claim was pursued on the basis that one of the “pointless” gloves got caught on the circular saw blade, drawing the clients hand onto the saw blade.

Insurers for the main contractors who insisted on these gloves being worn conceded responsibility and the client achieved an award of over £10,000.
