Who is liable in a multi-vehicle accident?

A crash in Whitefield involving four vehicles has highlighted the potential complexity of road traffic accident cases.

Not only did the four cars collide, but one veered off the road and into the front of a house through its bay window – causing a flood as well as the expected superficial damage. Nine passengers (including drivers) were involved in the crash, and six of them – including three children – were taken to hospital. Thankfully there were no fatalities.

This raises an interesting question: Who is to blame in a scenario like this? The more cars involved in an incident, the less black-and-white the liability aspect.

How does the law work when more than two vehicles are involved?

For you to be successful in a road traffic accident claim, you (with the aid of your solicitor) must be able to prove that another driver was at fault. If you caused it, you have no case.

Generally, any vehicle that hits a car ahead of it is liable for that specific collision. So, in the case of multi-car accidents, there can be several cars held accountable.

For example, if car one suddenly brakes and car two crashes into the back of it, car two is liable because it should have been travelling at a safe-enough distance behind car one (allowing it to brake in time). If a third car was then to run into the back of car two, this collision would be car three’s fault.

In many traffic accident cases, it is clear who was at fault and establishing blame is straightforward. However, sometimes it is not clear – even if just two vehicles were involved.
